Copyright Policy (DMCA)

2raywall Solutions Inc. (“2raywall”, “we”, “us”, or “our”) respects the intellectual property rights of others and expects users of the CruiseControl platform and websites (the “Service”) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, we will respond to properly submitted notices of alleged copyright infringement. This policy describes how to submit a notice, how to submit a counter-notification, and our policy regarding repeat infringers.

FILING A NOTICE OF INFRINGEMENT (DMCA TAKEDOWN)

If you believe that material available on or through the Service infringes a copyright you own or control, you may submit a written notification to our Designated Agent that includes substantially the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
  3. Identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient to permit us to locate the material (such as the URL or specific location);
  4. Your contact information, including your name, address, telephone number, and email address;
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Upon receipt of a valid notice, we will remove or disable access to the material and take reasonable steps to notify the user who posted it. Please be advised that under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys’ fees, if you knowingly and materially misrepresent that material is infringing.

COUNTER-NOTIFICATION

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Agent that includes substantially the following, as required by 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature;
  2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled;
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number; and
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notification or that person’s agent.

If we receive a valid counter-notification, we may restore the removed material in not less than 10 and not more than 14 business days after receipt, unless the original complainant notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity. Knowing material misrepresentations in a counter-notification may also give rise to liability under 17 U.S.C. § 512(f).

REPEAT INFRINGER POLICY

In appropriate circumstances and in our sole discretion, we will disable and/or terminate the accounts of users who are determined to be repeat infringers, and we may take such action without prior notice.
